How Is Spousal Support Calculated in the United States?
The best alimony lawyers understand that a final support order that reflects the true financial reality of marriage requires a blend of robust courtroom advocacy, effective mediation and forensic accounting. California’s laws provide for temporary spousal support during divorce proceedings, using a statewide guideline formula. Here, 50% of the lower earner’s income is subtracted from the 40% of the higher earner’s income.
For final orders, judges must consider a wide range of factors listed under Family Code Section 4320, along with the formula, to make a more accurate calculation. Our spousal support attorneys are some of the best in California and are highly skilled mediators, facilitating fair and equitable outcomes with a proven track record you can rely on.
How Long Does Spousal Support Last After Divorce?
The length of the marriage plays an important role in determining how long spousal support continues after the marriage ends. For instance, judges reserve jurisdiction on marriages that have lasted 10+ years, where support payments could continue untill remarriage of the spouse or the death of either party.
For marriages less than 10 years, spousal support is awarded for half the length of the marriage. So if you’ve been married for 8 years, you are eligible to receive or pay spousal support for 4 years, depending on your earnings.
However, in both cases, it's important that the supported spouse becomes financially independent within a reasonable period through gainful employment. Our alimony attorneys can help advocate for fair support terms, bearing in mind how these timelines can apply to your specific circumstances, to ensure your long-term stability.
Can Spousal Support Be Modified or Terminated?
A significant material change in circumstances can be grounds for modification of spousal support orders unless a final order is specifically labeled as non-modifiable. Changes such as an increase in the income of the spouse providing support or a loss of employment of the spouse receiving support can be grounds for modification.
The death of either spouse or changes in the relationship status of the recipient spouse, such as cohabitation/remarriage with a new partner, become grounds for termination of spousal support. Any changes to the final order can be made only through a Request for Order (FL-300). This is time-sensitive and must be done quickly, as courts cannot make retroactive modifications to spousal support.
Next Legal’s spousal support lawyers will help you gather evidence and organize documentation to demonstrate substantial changes to warrant modification in support orders. From court filings and ensuring requests are aligned with California laws to handling procedural matters, we’re with you every step of the way.
